New York State Proposed Disability Benefits Increase Fails to Pass State Assembly

An attempt to reform New York State’s Disability Benefits Law (DBL) has failed to pass the state’s Assembly. The proposed increases would have provided a significant boost to disability beneficiaries within the state. The new calculation would have tied disability benefits to employee earnings, allowing recipients to earn as much as 50% of the state’s average weekly wage.
Due to the state Assembly’s inaction, the state’s Disability Benefits continue to provide 50% of eligible wages weekly (up to a maximum of $170) for 26 weeks. Employers need not alter their disability policies for the foreseeable future.
