New Jersey Statutory Leave Update (NJ TDI, FLI, FLA and Earned Sick Leave)

Important updates effective July 17, 2026 (impacts both inflight claims and claims that begin on/after 7/17/26)  

NJ TDI, NJ FLI and NJ Earned Sick Leave Update:

-Any employee who takes either NJ TDI or NJ FLI leave is entitled under both laws to job restoration to the same or equivalent position the employee held prior to leave.

-Any employee who is eligible for both NJ Earned Sick Leave and NJ TDI/FLI has the option to use either leave type and also may choose the order in which they take the leaves. However, employees are not permitted to take more than one type of paid leave at the same time during any one period.

-Please note: Employers are responsible for job restoration and protection.

NJ FLA Update:

-Employee eligibility has changed for NJ FLA:

-12 months of service has been reduced to 3 months of service; and

-1000 hours has been reduced to 250 base hours in the 12 months prior to leave.

-Covered employer now means 15+ employees (previously 30+ employees).

 

Employers should consult with their employment attorneys for guidance on the above rules.
