The New York State Commissioner of Health has re-affirmed the designation of COVID-19 as a highly contagious communicable disease that presents a serious risk of harm to the public health. This means that New York employers must continue to enforce their Disease Exposure Prevention Plans (safety plans adopted under the HERO Act) through January 15, 2022.

Employers should ensure that all parts of their Disease Exposure Prevention Plan are being followed by employees until this Commissioner designation has ended.
