The IRS has recently updated its Form I-9 (Employment Eligibility Verification). The most recent form is referred to by its release date: edition 08/01/23. This form is very similar to the previous form, but does contain a few key differences:

- The institution of a permanent remote completion option for the Form I-9. During the COVID-19 pandemic, a temporary remote option was put in place to allow the growing number of remote workers to electronically verify their immigration status. This change makes that process permanent.

- The addition of a few extra pieces of documentation that would satisfy the Form I-9 eligibility requirements.

- The optimization and shortening of the Form I-9 instructions.

Employers should replace their current Form I-9 with this updated one as soon as possible. All Forms I-9 must be replaced with the most updated version by 11/1/23.

Employers need not have employees complete the updated Form I-9 if they have a previous version of the I-9 for that employee on file (unless that form must otherwise be updated).
