New York State Adds Additional Requirements to Lactation Accommodation Mandate

New York State has recently added two additional compliance requirements to their Lactation Accommodation Mandate:

 

- Employers must post their lactation accommodation policy on their website and must provide a physical copy to all employees.

- Employers must allow employees to take lactation breaks up to 30 minutes each time they have a reasonable need to express breast milk (this may include multiple times per day). Employers must provide these breaks for up to three years after the birth of the child.

 

Employers should update their Lactation Accommodation policies to reflect these new regulations. Employers should also ensure there is a method to effectively allow eligible employees to request and take lactation breaks during the workday.
