New York State Implements New Criminal History Notice Requirements for Employers
New York State has recently announced new requirements for employers in the state who wish to perform criminal history checks on their applicants. In addition to other state and federal requirements, employers must now provide the following documentation at the time a background check is completed:
- A copy of the criminal history report received by the employer;
- A copy of Article 23-A of the New York Corrections Law; and
- Notice of employee right to seek correction of inaccurate criminal history information
Employers in New York State should begin to implement these new notice requirements as soon as possible.
