New York State to Provide Leave for Public Employees to be Vaccinated

The New York State Legislature has officially passed Assembly Bill A-3354B. This bill requires allows public employees to take up to 4 hours of paid leave (at regular rate of pay) for the purpose of a vaccination injection. The law specifies that it is a grant of 4 hours for each injection, meaning employees who take the vaccine with 2 separate injections will be entitled to 8 hours of paid leave.

 

This law adds additional leave to all leave already required by state and federal law. This law may be superseded by a collective bargaining agreement or a company policy providing at least as much paid leave (with at least as favorable conditions on use).

 

This law has not yet been signed by Governor Andrew Cuomo. However, he is expected to sign it: employers should inform HR to create mechanisms for the administration and recording of this new leave.
