As provision after provision is released at both the state and federal level on a daily basis, employers become inundated with requests for leave under various new leave laws. The latest form of emergency leave comes from New York State in the form of Emergency COVID-19 Paid Sick Leave, which we have previously detailed HERE.  New York State has released a model COVID-19 Paid Sick Leave poster explaining the regulations for employers to distribute to employees. It is an employer’s responsibility under the law to inform his or her employees about their rights and responsibilities regarding this new leave. An employer should ensure that employees as given physical (through their last known address) and electronic (if the employee had previously consented to receiving employment notices electronically) copies of the model policy. If the employer has any employees currently onsite (or will have employees onsite before the end of the COVID-19 pandemic), the employer should also post this notice in a conspicuous location frequented by employees.
